Terms of Sale — Loomie

Last updated: 22 September 2026

Preamble

These Terms of Sale (hereinafter the "Terms") govern the sale of cosmetic products (in particular lip balms) by Becaert Samuel, sole trader (micro-enterprise), registered under SIRET number 925 389 629 00021, whose registered office is at 56 avenue Monclar, 84000 Avignon, France (hereinafter "Loomie", "we"), via the website loomie.eu (hereinafter "the Site"), to any non-professional consumer (hereinafter "the Customer", "you").

Placing an order on the Site implies full and complete acceptance of these Terms, to the exclusion of any other document. The Terms are available at all times on the Site and prevail over any other version or any contradictory document.

Article 1 — Products

Loomie sells cosmetic products (lip balms and related products) whose essential characteristics are presented on each product page of the Site, in accordance with article L.111-1 of the French Consumer Code. Product photographs are not contractually binding.

Article 2 — Prices

Prices are shown in euros (€), all taxes included. As Loomie benefits from the VAT exemption scheme (art. 293 B of the French General Tax Code), the mention "VAT not applicable" will be stated for as long as this status applies.

Shipping costs are shown before the order is finally confirmed and are added to the price of the products, unless otherwise stated (e.g. free shipping above a certain amount).

Loomie reserves the right to change its prices at any time, it being understood that the price applicable to an order is the one in force when the Customer confirms it.

Article 3 — Orders

The Customer selects the desired products, adds them to the cart, then confirms the order by following the steps shown on the Site (summary, delivery details, payment method). Confirming the order with payment constitutes firm and final acceptance of the order.

An order confirmation email is sent to the Customer at the address given when ordering.

Loomie reserves the right to refuse or cancel any order in the event of a previous dispute with the Customer, suspected fraud, or product unavailability; the Customer will then be informed and refunded where applicable.

Article 4 — Payment

Payment is made online at the time of ordering, using the methods offered on the Site (bank card and, where applicable, other methods offered via Shopify Payments or another provider). Transactions are secure.

The Customer warrants that they hold the necessary authorisations to use the chosen payment method.

Article 5 — Delivery

Delivery terms (areas served, lead times, carriers, rates) are detailed in our Shipping Policy, which forms an integral part of these Terms.

Article 6 — Right of withdrawal

6.1 Principle

In accordance with articles L.221-18 et seq. of the French Consumer Code, the Customer has 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to give reasons or pay penalties, except for return costs.

To exercise this right, the Customer informs Loomie of their decision by means of an unambiguous statement (email to team@loomie.eu or the model form attached in the appendix) before the 14-day period expires.

6.2 Exception applicable to our products — hygiene

In accordance with article L.221-28, 6° of the French Consumer Code, the right of withdrawal cannot be exercised for goods that have been unsealed by the Customer after delivery and which cannot be returned for reasons of hygiene or health protection.

As our lip balms are cosmetic products applied directly to the skin, this exception applies in full: the right of withdrawal can only be exercised if the product is returned unopened, still sealed and unused, in its intact original packaging. A product that has been opened, unsealed or whose protective packaging has been removed cannot be taken back or refunded under the right of withdrawal, for hygiene reasons.

This exception does not deprive the Customer of the legal guarantee of conformity in the event of a defective product (see article 7).

6.3 Online withdrawal function

In accordance with article L.221-21 of the French Consumer Code (as amended by ordinance no. 2026-2 of 5 January 2026, applicable since 19 June 2026), Loomie provides the Customer with a free and easily accessible function for notifying their withdrawal, available by email at team@loomie.eu by stating the order number.

6.4 Refund

In the event of a valid withdrawal, Loomie refunds all sums paid, including standard shipping costs, no later than 14 days after being informed of the withdrawal decision, subject to receipt of the returned product or proof of shipment. The refund is made using the same payment method as the one used for the order, unless otherwise agreed.

Article 7 — Legal guarantees

Independently of the right of withdrawal, every product automatically benefits, at no extra cost, from:

  • the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code), for 2 years from delivery of the goods;
  • the legal guarantee against hidden defects (articles 1641 et seq. of the French Civil Code), for 2 years from discovery of the defect.

In the event of a proven lack of conformity or hidden defect, the Customer may request repair, replacement or refund of the product by writing to team@loomie.eu.

For more details, see our Returns and Refunds Policy.

Article 8 — Liability

Loomie cannot be held liable for non-performance of the contract in the event of force majeure, stock shortage or product unavailability, or fault of the Customer. The products are intended for cosmetic use in accordance with the instructions on their packaging; Loomie cannot be held liable for improper use, in particular in the event of an allergy not reported by the Customer.

Article 9 — Personal data

The processing of the Customer's personal data in connection with the order is described in the legal notice and privacy policy of the Site, in accordance with the GDPR.

Article 10 — Mediation and disputes

In the event of a dispute, the Customer is invited to contact Loomie first at team@loomie.eu in order to seek an amicable solution.

Failing an amicable resolution, in accordance with article L.616-1 of the French Consumer Code, the Customer has the right to use a consumer mediator free of charge.

Mediator : CM2C – Centre de Médiation de la Consommation de Conciliateurs de Justice

Website: cm2c.net Address: 14 rue Saint Jean, 75017 Paris, France

Article 11 — Applicable law and jurisdiction

These Terms are governed by French law. In the event of a dispute not resolved amicably or through mediation, the competent French courts will be those of the defendant's place of residence or, at the consumer Customer's choice, of the place of delivery of the product.
